Abstrakt

Artykuł stanowi analizę tortur w perspektywie fenomenologicznej. W pierwszej części analizuję definicję tortur ONZ. Na tym tle pokazuję, że prawne rozumienie tortur opiera się na nieokreślonych i niezdefiniowanych pojęciach radykalnego bólu i cierpienia. To spostrzeżenie prowadzi mnie do fenomenologicznej próby odpowiedzi na pytanie: co konstytuuje cierpienie ofiary tortur? W drugiej części artykułu przedstawiam rozerwanie podmiotowości jako główne źródło cierpienia ofiary. W zakończeniu pokazuje, jak moje analizy mogą wzmocnić argumentacje przeciwko możliwości użycia tortur.
