Abstract

The aim of the article is to polemicize with the views of Bartłomiej Wiklański – the author of the article entitled “Tryb zamówienia z wolnej ręki a zasada konkurencyjności w prawie zamówień publicznych” [transl. Single-source procurement and the principle of competition in public procurement law], which was published in issue 1(47)/2024 of “Acta Iuris Stetinensis”. Wiklański identifies the principle of competition, which he considers the essence of public procurement, with the competitiveness of the procurement procedure. In fact, the principle of competition is not the same as the competitiveness of procedure. A non-competitive procedure, such as single-source procurement, can be reconciled with the principle of competition, which is the basis of the legal conditions for the use of single-source procurement and is the reason why these conditions are subject to a narrow interpretation. As a result, the conclusions formulated by Wiklański have not been properly justified: there is no evidence that the single-source procurement procedure is too easily accessible to contracting authorities and legislative changes are necessary to combine the single-source procurement procedure with negotiations without publication.
