(Personal participation in criminal proceedings in light of recent amendments: an ongoing decline)

Abstract

The accused’s right to personal participation in criminal proceedings is an inherent element of a fair trial. In the light of ECHR standards, as well as Directive 2016/343/EU, a trial in absentia is allowed, provided that the authorities made reasonable efforts to inform the accused of the forthcoming hearing and the accused may apply for a full re-trial in case of their re-appearance. In recent years, Polish legislation has continued the previous tendency (e.g. the criticized Article 378a of the Code of Criminal Procedure) to reduce these standards. During the coronavirus pandemic, it was made possible to conduct trials with only remote participation of the accused deprived of liberty (Article 374 § 4 of the Code of Criminal Procedure). This solution should not be rejected a limine, but what is controversial is the fact that the initiative was granted to the court and not the person concerned, as well as the regulation of the very limited contacts with a defense lawyer in the courtroom. The possibility of a break during a hearing (Article 374 § 7 of the Code of Criminal Procedure) does not seem functional or sufficient. Also the amendments introduced by the Act of 7 July 2023 raise serious concerns. First, in some cases, a possibility to temporarily remove the accused from the courtroom at request of the injured party has been introduced (Article 390 § 4 of the Code of Criminal Procedure). It should be assessed very critically, especially since it was already possible to temporarily remove the defendant by the court (Article 390 § 2 of the Code of Criminal Procedure). Secondly, in the light of the amended Art. 133 § 2a of the Code of Criminal Procedure notice of the first date of the main hearing will be able to be delivered to a person appointed as the postal representative other than the accused, which was previously unacceptable. The direction of changes chosen by the legislator is a manifestation of further decline of the defendant’s right to personal participation in the trial, which undermines the standard of a fair trial and, in the longer term, may threaten effective cooperation between Poland and other EU Member States in criminal matters, including the execution of EAWs.
