(The Role of the Constitutional Court in the Procedure of Amending the Constitution of the Republic of Kosovo)

Abstract

The primary objective of the reflections presented in this article is to examine the role of the Constitutional Court in the procedure for amending the Constitution of the Republic of Kosovo. This procedure plays an extremely significant constitutional role as it determines the possibility of adapting the basic law to society’s current needs. Only a few countries carry out reviews of constitutionality of constitutional amendments. The potential impact of such a review on the rigidity of the fundamental law remains significant, as it seems it may contribute to making amendments more difficult. The right to initiate constitutional amendments is held by members of parliament and the executive authorities (the President and the Government). The participation of the Constitutional Court in the amendment procedure, which reviews the constitutionality of proposed changes, brings a certain balance to this arrangement. The basic law also provides arguments that the review conducted by the Court is both substantive and formal. A praxeological analysis of selected aspects of the constitutional court’s activities leads to the conclusion that the Court, by reviewing proposed amendments, has significantly expanded its competencies. The justification for such a stance by the Court can be found in its authority to provide the final interpretation of the Constitution. The research also relies on an investigation of the provisions of the Constitution of the Republic of Kosovo from April 8, 2008, the law on the Constitutional Court, parliamentary regulations, and the jurisprudence of the Kosovo Constitutional Court.
