Abstract

A theory of law bases oneself on a philosophy and should be a foundation for penal law science. The conception of a penalistic interpretation, as a sort of a humanistic interpretation, can be used in an analysis of provisions of a penal code of 1969 and in an analysis of provisions of a penal code of 1997. According to this conception a knowledge of a perpetrator of an act is its main cause. A knowledge is strictly connected with a guilt, but this connection is different in either penal codes.
