Abstract

The aim of this article is to present a historical analysis of the determinants of development of the modern judiciary and prosecutor’s office and their role, both in society as a whole and strictly in criminal proceedings, as well as to analyse of the role of the prosecutor in the criminal process, both as a model and in the context of recent normative changes. The author analyzes the amendments to criminal law that have taken place in recent years, pointing out that they have resulted in a significant expansion of the prosecutor’s competences in criminal proceedings, especially at the stage of jurisdictional proceedings, where he took over some of the powers previously reserved for the court. The author criticizes these changes from the point of view of compliance with the conventional model of a fair trial, pointing out that these changes are part of a broader normative context of a general move towards greater punitiveness of criminal law, which can be observed in recent years. The article is a written version of the speech delivered by the author during a scientific conference.
