Abstract

This commentary concerns a decision of the Supreme Court, which acquitted an offender who has repeatedly used a drone over private property not belonging to him of the offense of maliciously disturbing another person in order to annoy him (Article 107 of the Code of Minor Offences). The analysed ruling is important in terms of establishing the direction of judicial decisions as to the increasingly widespread private use of unmanned aerial vehicles (so-called drones), as well as the applicability of the said provision of the Code of Minor Offences in similar cases. The purpose of the study is to provide commentary on the SC ruling in question. For this purpose, the method of investigation of the law in force and the method of analysis of judicial decisions are used.
