Abstract
Opening of bankruptcy proceedings including liquidation of the bankrupt’s assets effects current contracts to which debtor is party. The effects of bankruptcy proceedings on current contracts to which debtor is party may be divided into two groups. The first group covers effects taking place form the moment of opening of bankruptcy proceedings by force of law. The other group of effects constitute legal basis for the syndic to modify current contracts taking into account concrete circumstances of the debtor’s situation. The Polish legislator seems to be not consistent regarding service contracts in case of bankruptcy proceedings taking into account Article 98 and 102 of bankruptcy law. The article deals with problem of legal effects of bankruptcy law regarding service contract indicating the necessity to protect the interests of creditors as well as the interests of third parties.
