Legal issues of hyperlinking in copyright and related rights

Abstrakt

Hiperłącza mają zasadnicze znaczenie dla funkcjonowania Internetu, ponieważ ułatwiają płynny dostęp do treści różnych stron internetowych, natomiast z drugiej strony ich obecność wywołuje liczne kontrowersje dotyczące praw autorskich. Niniejsze opracowanie analizuje kryteria ustalone przez Trybunał Sprawiedliwości Unii Europejskiej w celu określenia, kiedy hiperłącze stanowi „publiczne udostępnienie”, i porównuje to podejście z tym, stosowanym w Stanach Zjednoczonych, gdzie spory dotyczące hiperłączy są często traktowane jako kwestie nieuczciwej konkurencji, a nie jako naruszenie praw autorskich. Poprzez analizę prawnoporównawczą i przegląd orzecznictwa artykuł ten przedstawia wiodące sprawy w sądzie europejskim, takie jak Svensson, GS Media i Renckhoff, a także sprawy amerykańskie, takie jak Ticketmaster v. Microsoft. Wyniki pokazują, że chociaż Unia Europejska zapewnia pewne wytyczne dotyczące korzystania z hiperłączy, nie są one spójne we wszystkich sprawach. Z kolei prawo amerykańskie traktuje hiperłącza bardziej jako narzędzia funkcjonalne, które często nie podlegają kontroli praw autorskich. Analiza ta podkreśla trudności w pogodzeniu ochrony praw autorskich w środowisku cyfrowym z funkcjonalnym charakterem hiperlinkowania.
